1. General

The operator of the www.econoxx.com website (hereafter called the “ECONOXX-Platform”) is Hempel Special Metals AG based in Dübendorf (hereafter called “ECONOXX”).

 Data Protection is extremely important to ECONOXX. This Data Protection Declaration sets out the way in which ECONOXX deals with personal information and illustrates in particular which of the personal details of visitors to the ECONOXX platform and registered customers of the associated marketplace (hereafter jointly called “Users”) will be processed by ECONOXX and for what purpose these details will be processed. It also describes the way in which the collected personal details may be checked, corrected or deleted.

 This Data Protection Declaration forms an integral part of the “Terms & Conditions of Service” and the “General Terms & Conditions of Business” of ECONOXX.

2. Acknowledgement of the Data Protection Declaration

Visitors automatically declare their agreement to this Data Protection Declaration when they use the website.

Registered customers of the ECONOXX platform then confirm their additional acceptance of this Data Protection Declaration by clicking on the “I agree to the General Terms & Conditions of Business and the Data Protection Declaration" button.

In particular, Users declare their agreement to the collection of personal details in accordance with Clause 3 below and with the use of these details in accordance with Clauses 4-6 below.

3. Personal information

ECONOXX respects the privacy of the User and will not collect any personal details (such as name, address or e-mail address) unless these details have been provided voluntarily by the User as part of his/her registration on the ECONOXX platform or during the subsequent use of the ECONOXX platform, or have been automatically captured by means of cookies.

 As part of the registration process, ECONOXX customers are required to provide the following obligatory information:

• Business name plus first name and surname of the person making contact

• E-mail address

• Invoicing address

• Delivery address

• Telephone number (land line and/or mobile)

• VAT/Tax ID no.

4. Use of personal information

Details supplied by Users to ECONOXX may be used by ECONOXX as follows:

• To set up a User Account;

• For marketing purposes, i.e. specifically in order to better understand the needs of the User and to improve the services provided by ECONOXX;

• In order to carry out transactions with the User;

• In order to facilitate transactions between Users (including the transfer of the details to the individuals and businesses selected by the User);

 Access to personal details is restricted to those employees who need to know this information. ECONOXX will in no case sell personal information to third parties or exploit it in any other way.

5. Cookies

When Users visit the ECONOXX platform, information may be automatically saved to their computers. This takes place in the form of so-called “cookies” or other similar files, which can be of assistance to ECONOXX in a variety of ways, e.g. to learn about the preferences of the visitor to the ECONOXX platform and to improve the ECONOXX platform. Most browsers allow cookies to be deleted or their installation to be prevented or for a warning to be generated before a cookie is installed. Users can find further information on this subject in their browser instructions. ECONOXX will only use automatically-stored information for statistical evaluation purposes and will specifically not link it to any personal details that may have been provided to ECONOXX.

6. Google Analytics

Google Analytics is a web analysis service provided by Google Inc. ("Google"). Google Analytics uses “cookies”, which are text files that are stored on the User’s computer and enable the use of the website to be analysed. The information generated by the cookie regarding the use of this website (including the IP address of the User) is transmitted to a server belonging to Google in the USA and stored there. Google will use this information to evaluate the use of the website by the User, in order to put together reports on website activities for the website operator and to perform other services linked to the use of the website and the internet. Google may also pass this information on to third parties, to the extent that this is legally prescribed or to the extent that third parties process this information on behalf of Google. In no event will Google link the IP address of the User to other information held by Google. Users can prevent the installation of these cookies by choosing the appropriate setting in the browser software; however, ECONOXX would advise the User that some of the functions of the ECONOXX platform may then be impossible to use in full. By using the ECONOXX platform, Users confirm their agreement to the processing by Google of the information obtained about them in the manner described above and for the purpose previously specified.

7. Security measures

ECONOXX provides security measures in order to prevent the loss, misuse or modification of information and personal details. Account information is password protected in order that only Users shall have access to their own personal information, with the exception of the details set out in this Data Protection Declaration. Users shall be aware that the transmission of data over the internet is not secure. Once ECONOXX has received the transmitted information, it will secure it by appropriate methods within its own systems.

8. The rights of the User

Users can at any stage require ECONOXX to send them a copy of any personal details that relate to them, or obtain information about how these details have been used. In addition, ECONOXX will correct or delete the details at any stage at the request of the User.

9. Revision of the Data Protection Declaration

ECONOXX is entitled to revise this Data Protection Declaration at its own discretion. Any changes will be indicated to the User on the ECONOXX platform.
